Real Estate Tax exemption under the Minimis aid.
Resolution No. XI/73/15 of the City Council in Bierutów, dated June 18, 2015 and amended by Resolution No. XXVII/332/20of the City Council of Bierutów, dated December 30, 2020.
The basic form of public aid offered to entrepreneurs in the WSEZ is exempt from income tax on income obtained from conducting business activities in the zone. The amount of state aid depends on the investment expenses incurred by the Investor related to the new investment and the size of the enterprise.
The maximum allowable public aid for large enterprises in Lower Silesia is 25% of capital expenditure. It is increased to 35% for medium-sized enterprises, whilst small-sized enterprises are entitled to as much as 45%.
Capital expenditures include capital outlay eligible for public aid or two-year labour costs of newly hired employees relating to a new investment carried out in the zone.
Investment outlays eligible for aid are investment costs less VAT and Excise tax (if the possibility of their deduction results from separate regulations) incurred in the zone during the validity of the permit, including:
The purchase price of land or the right of perpetual usufruct of land.
The purchase price or production costs of fixed assets.
The cost of expansion or modernisation of the existing fixed assets.
The purchase price of intangible and legal assets.
The costs of renting or leasing the land, buildings and structures for a minimum duration of 5 years in the case of large investors and or 3 years in the case of small and medium-sized investors.
The purchase price of assets other than the land, buildings and structures which are rented or leased, where the rent or the lease are in the form of a finance lease include and obligation to acquire the assets on the expiry of the rental or lease period.
The two-year labour costs of newly recruited employees include gross wage costs plus compulsory contributions, such as social security contributions, incurred by the entrepreneur from the date of employment of these employees.
Exemption from a legal and natural person’s income tax is granted from the month in which the entrepreneur incurred investment expenses or labour costs, until the state aid is exhausted.
Various forms of state aid, such as: EU subsidies, exemptions from local property and building taxes, grants and loans granted to entrepreneurs by the local job center for the creation of new jobs and training of previously unemployed people are subject to summation and reduce the amount of state aid available to the entrepreneur. Government grants are awarded on the basis of the “Programme for Supporting Investments of Significant Importance to the Polish economy for the years 2011-2023” (hereinafter referred to as the Programme) adopted by the Council of Ministers on July 5, 2011.
The support is given in the form of a grant on the basis of a bilateral agreement concluded between the Minister of Economy and the Investor. The agreement shall regulate in detail the conditions for the payment of the grant, whilst maintaining the principle that the grant is paid in proportion to the degree of liabilities implemented. Only entrepreneurs planning to invest in the following priority sectors may apply for support:

Research and development activities.
In addition, entrepreneurs planning production investments in other sectors with a minimum eligible cost of PLN 750 million and creating at least 200 new jobs, or with a minimum eligible cost of PLN 500 million and creating at least 500 new jobs (significant investment) may apply for support.
